本议定书各缔约国,
作为1969年11月29日在布鲁塞尔签订的国际干预公海油污事故公约的缔约国,
考虑到1969年海洋污染损害国际法律会议所通过的关于非油类污染物的国际合作决议,
还考虑到,按照该项决议,政府间海事协商组织*与一切有关的国际组织合作,已加强了其在非油类污染物的各个方面的工作,兹协定如下:

第一条
1.本议定书的缔约国,在发生海上事故或与这种事故有关的行为后,如有理由预计到将造成重大的有害后果,则可在公海上採取必要的措施,以防止、减轻或消除由于非油类物质造成污染或污染威胁而对其海岸或有关利益产生的严重而紧迫的危险。
2.第1款中所指的“非油类物质”为:
(1)列于由本组织指定的适当机构所制订的名单中的物质,该项名单应作为本议定书的附属档案,以及
(2)其他易于危害人类健康,伤害生物资源和海生物、损害休憩环境或妨害对海洋的其他合法利用的物质。
3.每当进行干预的缔约国就上述第2款第(2)项中所述物质採取行动时,该缔约国有责任确证,该物质在进行干预时的情况下,会产生类似于上述第2款第(1)项所述名单中列举的任何物质所产生的严重而紧迫的危险。
第二条
1.1969年干预公海油污事故公约第一条第2款和第二至八条以及其附属档案的规定,应如同其适用于油类一样,适用于本议定书第一条中所述的物质。
2.就本议定书而言,该公约第三条第3款和第四条中所述的专家名单应予扩大,以包括能在非油类物质方面提供意见的专家。其人选由本组织的会员国和本议定书的缔约国提出。
第三条
1.第一条第2款第(1)项中所述的质物名单,应由本组织指定的适当机构保持常新。
2.本议定书的任一缔约国对该名单所提议的修正案,应提交本组织,并由本组织在该适当机构对之进行审议前至少3个月转发给本组织的所有会员国和本议定书的所有缔约国。
3.本议定书的缔约国,不论其是否为本组织的会员国,均有权参加该适当机构的会议。
4.修正案须以到会并投票的本议定书缔约国的2/3多数票通过。
5.修正案如按上述第4款的规定获得通过,则本组织应将其通知本议定书的所有缔约国,以供接受。
6.该修正案,在通知后满6个月时,应视为已被接受,除非在此期限内有不少于1/3的本议定书的缔约国通知本组织表示反对。
7.凡按上述第6款规定视为已被接受的修正案,应在其被接受后过3个月,对本议定书的所有缔约国生效,但对在该日期前声明不予接受者除外。
第四条
1.本议定书对已签署或已加入第二条中所述公约的国家和被邀请出席1973年国际海洋污染会议的国家开放供签字,并自1974年1月15日起至1974年12月31日止在本组织总部继续开放供签字。
2.除本条第4款的规定外,本议定书须经已签字的国家批准、接受或认可。
3.除第4款的规定外,本议定书应对未签字的国家开放供加入。
4.本议定书只可由业已批准、接受、认可或加入第二条中所述公约的国家批准、接受、认可或加入。
第五条
1.批准、接受、认可或加入,须以相应的正式档案交存本组织秘书长。
2.在本议定书的一项修正案已对所有现有缔约国生效之后或者在为该项修正案对所有现有缔约国生效所需的一切措施均已完成之后交存的任何批准、接受、认可或加入的档案,应认为适用于按该修正案所修订的本议定书。
第六条
1.本议定书应在已有15个国家向本组织秘书长交存批准、接受、认可或加入档案之日后第90天生效,但本议定书不得在第二条中所述的公约生效之前生效。
2.对于随后批准、接受、认可或加入本议定书的每个国家,本议定书应在该国交存相应的档案后第90天对之生效。
第七条
1.本议定书的任何缔约国,可在本议定书对之生效之日后,随时退出本议定书。
2.退出本议定书须以相应的档案交存本组织秘书长。
3.退出本议定书,应在将退出档案交存本组织秘书长后经过1年或该档案中所指明的较长期限届满后生效。
4.本议定书的一缔约国退出第二条所述的公约,即应视为也退出本议定书。这种退出,应在按照该公约第十二条第3款退出该公约生效之日同时生效。
第八条
1.本组织可召开修订或修正本议定书的会议。
2.在有不少于1/3的本议定书的缔约国提出要求时,本组织应召开缔约国会议,以修订或修正本议定书。
第九条
1.本议定书应交本组织秘书长保存。
2.本组织秘书长应:
(1)将下列情况通知所有已签署或加入本议定书的国家:
①每一新的签字或档案的交存,以及其日期;
②本议定书生效的日期;
③任何退出本议定书的档案的交存以及退出生效的日期。
④对本议定书或其附属档案的任何修正案,以及对该修正案的任何反对或不予接受的声明;
(2)将核证无误的本议定书的副本分送给已签署或加入本议定书的所有国家。
第十条
本议定书一经生效后,本组织秘书长应即按联合国宪章第一百零二条的规定,将核证无误的副本一份送联合国秘书处登记和公布。
第十一条
本议定书正本1份,用英文、法文、俄文和西班牙文写成,四种文本具有同等效力。
经正式授权的下列具名代表特签署本议定书,以昭信守。
附属档案:本组织海上环境保护委员会根据第一条第2款第(1)项制订的物质名单
国际海事组织于1973年11月23日在其第八届大会上以决议A·296(Ⅷ)指定海上环境保护委员会为本议定书第一条第2款第(1)项所述的适当机构。海上环境保护委员会经过审议,于1974年11月21日以决议MEPC·1(Ⅱ)通过了此附属档案。

ArticleI
1.PartiestothepresentProtocolmaytakesuchmeasuresonthehighseasasmaybenecessarytopreventmitigateoreliminategraveandimminentdangertotheircoastlineorrelatedinterestsfrompollutionorthreatofpollutionbysubstancesotherthanoilfollowinguponamaritimecasualtyoractsrelatedtosuchacasualty,whichmayreasonablybeexpectedtoresultinmajorharmfulconsequences.
2."Substancesotherthanoil"asreferredtoinparagraph1shallbe:
(a)thosesubstancesenumeratedinalistwhichshallbeestablishedbyanappropriatebodydesignatedbytheOrganizationandwhichshallbeannexedtothepresentProtocol,and
(b)thoseothersubstanceswhichareliabletocreatehazardstohumanhealth,toharmlivingresourcesandmarinelife.todamageamenitiesortointerferewithotherlegitimateusesofthesea.
3.WheneveraninterveningPartytakesactionwithregardtoasubstancereferredtoinparagraph2(b)abovethatPartyshallhavetheburdenofestablishingthatthesubstance,underthecircumstancespresentatthetimeoftheintervention.couldreasonablyposeagraveandimminentdangeranalogoustothatposedbyanyofthesubstancesenumeratedinthelistreferredtoinparagraph2(a)above.
ArticleII
1.Theprovisionsofparagraph2ofArticleIandofArticlesIItoⅧoftheConventionRelatingtoInterventionontheHighSeasinCasesofOilPollutionCasualties,1969,andtheAnnextheretoastheyrelatetooil,shallbeapplicablewithregardtothesubstancesreferredtoinArticleIofthepresentProtocol.
2.ForthepurposeofthepresentProtocolthelistofexpertsreferredtoinArticlesIII(c)andIVoftheConventionshallbeextendedtoincludeexpertsqualifiedtogiveadviceinrelationtosubstancesotherthanoil.NominationstothelistmaybemadebyMemberStatesoftheOrganizationandbyPartiestothepresentProtocol.
ArticleIII
1.Thelistreferredtoinparagraph2(a)ofArticleIshallbemaintainedbytheappropriatebodydesignatedbytheOrganization.
2.AnyamendmenttothelistproposedbyaPartytothepresentProtocolshallbesubmittedtotheOrganizationandcirculatedbyittoallMembersoftheOrganizationandallPartiestothepresentProtocolatleastthreemonthspriortoitsconsiderationbytheappropriatebody.
3.PartiestothepresentProtocolwhetherornotMembersoftheOrganizationshallbeentitledtoparticipateintheproceedingsoftheappropriatebody.
4.Amendmentsshallbeadoptedbyatwo-thirdsmajorityofonlythePartiestothepresentProtocolpresentandvoting.
5.Ifadoptedinaccordancewithparagraph4above,theamendmentshallbecommunicatedbytheOrganizationtoallPartiestothepresentProtocolforacceptance.
6.Theamendmentshallbedeemedtohavebeenacceptedattheendofaperiodofsixmonthsafterithasbeencommunicated,unlesswithinthatperiodanobjectiontotheamendmenthasbeencommunicatedtotheOrganizationbynotlessthanone-thirdofthePartiestothepresentProtocol.
7.Anamendmentdeemedtohavebeenacceptedinaccordancewithparagraph6aboveshallenterintoforcethreemonthsafteritsacceptanceforallPartiestothepresentProtocol,withtheexceptionofthosewhichbeforethatdatehavemadeadeclarationofnon-acceptanceofthesaidamendment.
ArticleIV
1.ThepresentProtocolshallbeopenforsignaturebytheStateswhichhavesignedtheConventionreferredtoinArticleIIoraccededthereto,andbyanyStateinvitedtoberepresentedattheInternationalConferenceonMarinePollution1973.TheProtocolshallremainopenforsignaturefromJanuary15,1974untilDecember31,1974attheHeadquartersoftheOrganization.
2.Subjecttoparagraph4ofthisArticle,thepresentProtocolshallbesubjecttoratification.acceptanceorapprovalbytheStateswhichhavesignedit.
3.Subjecttoparagraph4,thisProtocolshallbeopenforaccessionbyStateswhichdidnotsignit.
4.ThepresentProtocolmayberatified,accepted,approvedoraccededtoonlybyStateswhichhaveratified,acceptedapprovedoraccededtotheConventionreferredtoinArticleII.
ArticleV
1.Ratification,acceptance,approvaloraccessionshallbeeffectedbythedepositofaformalinstrumenttothateffectwiththeSecretary-GeneraloftheOrganization.
2.Anyinstrumentofratification,acceptance,approvaloraccessiondepositedaftertheentryintoforceofanamendmenttothepresentProtocolwithrespecttoallexistingPartiesorafterthecompletionofallmeasuresrequiredfortheentryintoforceoftheamendmentwithrespecttoallexistingPartiesshallbedeemedtoapplytotheProtocolasmodifiedbytheamendment.
ArticleVI
1.thepresentProtocolshallenterintoforceontheninetiethdayfollowingthedateonwhichfifteenStateshavedepositedinstrumentsofratification,acceptance,approvaloraccessionwiththeSecretary-GeneraloftheOrganization,providedhoweverthatthepresentProtocolshallnotenterintoforcebeforetheConventionreferredtoinArticleIIhasenteredintoforce.
2.ForeachStatewhichsubsequentlyratifies,accepts,approvesoraccedestoit,thepresentProtocolshallenterintoforceontheninetiethdayafterthedepositbysuchStateoftheappropriateinstrument.
ArticleVII
1.ThePresentProtocolmaybedenouncedbyanyPartyatanytimeafterthedateonwhichtheProtocolentersintoforceforthatParty.
2.DenunciationshallbeeffectedbythedepositofaninstrumenttothateffectwiththeSecretary-GeneraloftheOrganization.
3.Denunciationshalltakeeffectoneyear,orsuchlongerperiodasmaybespecifiedintheinstrumentofdenunciationafteritsdepositwiththeSecretary-GeneraloftheOrganization.
4.DenunciationoftheConventionreferredtoinArticleIIbyaPartyshallbedeemedtobeadenunciationofthepresentProtocolbythatParty,Suchdenunciationshalltakeeffectonthesamedayasthe
denunciationoftheConventiontakeseffectinaccordancewithparagraph3ofArticleXIIIofthatconvention.
ArticleVIII
1.AconferenceforthepurposeofrevisingoramendingthepresentProtocolmaybeconvenedbytheOrganisation.
2.TheOrganizationshallconveneaconferenceofPartiestothepresentProtocolforthepurposeofrevisingoramendingitattherequestofnotlessthanone-thirdoftheParties.
ArticleIX
1.ThepresentProtocolshallbedepositedwiththeSecretary-GeneraloftheOrganization.
2.TheSecretary-GeneraloftheOrganizationshall:
(a)informallStateswhichhavesignedthepresentProtocoloraccededtheretoof:
(i)eachnewsignatureordepositofaninstrumenttogetherwiththedatethereof;
(ii)thedateofentryintoforceofthepresentProtocol;
(iii)thedepositofanyinstrumentofdenunciationofthepresentProtocoltogetherwiththedateonwhichthedenunciationtakeseffect;
(iv)anyamendmentstothepresentProtocoloritsAnnexandanyobjectionordeclarationofnon-acceptanceofthesaidamendment;
(b)transmitcertifiedtruecopiesofthepresentProtocoltoallStateswhichhavesignedthepresentProtocoloraccededthereto.
ArticleX
AssoonasthepresentProtocolentersintoforce,acertifiedtruecopythereofshallbetransmittedbytheSecretary-GeneraloftheOrganizationtotheSecretarialoftheUnitedNationsforregistrationandpublicationinaccordancewithArticle102oftheCharteroftheUnitedNations.
ArticleXI
ThepresentProtocolisestablishedinasingleoriginalintheEnglish,French,RussianandSpanishlanguages,allfourtextsbeingequallyauthentic.
